A draft of a proposed legislation titled “Prevention of Communal and Targeted Violence (Access to Justice and Reparations) Bill, 2011” has been put in public domain. The draft Bill ostensibly appears to be a part of an endeavour to prevent and punish communal violence in the country. Though that may be the ostensible object of the proposed law its real object is to the contrary. It is a Bill which if it is ever enacted as a law will intrude into the domain of the State, damage the federal polity of India, and create an imbalance in the inter-community relationship of this country.
What does the Bill in effect state
The most vital definition of the Bill is of the expression ‘group’. A ‘group’ means a religious or linguistic minority and in a given State may include the Scheduled Castes and Scheduled Tribes. The Bill creates a whole set of new offences in Chapter II. Clause 6 clarifies that the offences under this Bill are in addition to the offences under the SC & ST (Prevention of Atrocities) Act, 1989. Can a person be punished twice for the same offence? Clause 7 prescribes that a person is said to commit sexual assault if he or she commits any of the sexual act against a person belonging to a ‘group’ by virtue of that person’s membership of a group. Clause 8 prescribes that ‘hate propaganda’ is an offence when a person by words oral or written or a visible representation causes hate against a ‘group’ or a person belonging to a ‘group’. Clause 9 creates an offence for communal and targeted violence. Any person who singly or jointly or acting under the influence of an association engages in unlawful activity directed against a ‘group’ is guilty of organised communal and targeted violence. Clause 10 provides for punishment of a person who expends or supplies money in the furtherance or support of an offence against a ‘group’. The offence of torture is made out under clause 12 where a public servant inflicts pain or a suffering, mental or physical, on a person belonging to a ‘group’. Clause 13 punishes a public servant for dereliction of duty in relation to offences mentioned in this Bill. Clause 14 punishes public servants who control the armed forces or security forces and fails to exercise control over people in his command in order to discharge their duty effectively. Clause 15 expands the principle of vicarious liability. An offence is deemed to be committed by a senior person or office-bearer of an association and he fails to exercise control over subordinates under his control or supervision. He is vicariously liable for an offence which is committed by some other person. Clause 16 renders orders of superiors as no defence for an alleged offence committed under this section.
Any communal trouble during which offences are committed is a law and order problem. Dealing with the law and order is squarely within the domain of the State Governments. In the division of powers between the Centre and the States, the Union Government has no direct authority to deal with the law and order issues; nor is it directly empowered to deal with them nor it can legislate on the subject. The Union Government’s jurisdiction restricts itself to issue advisories, directions and eventually forming an opinion under Article 356 that the governance of the State can be carried on in accordance with the Constitution or not. If the proposed Bill becomes a law, then effectively it is the Union Government which would have usurped the jurisdiction of the States and legislated on a subject squarely within the domain of the States.
India has been gradually moving towards a more amicable inter-community relationship. Even when minor communal or caste disturbances occur, there is a national mood of revulsion against them. The Governments, media, the courts among other institutions rise to perform their duty. The perpetrators of communal trouble should certainly be punished. This draft Bill however proceeds on a presumption that communal trouble is created only by members of the majority community and never by members of the minority community. Thus, offences committed by members of the majority community against members of the minority community are punishable. Identical offences committed by minority groups against the majority are not deemed to be offences at all. Thus a sexual assault is punishable under this Bill only if committed against a person belonging to a minority ‘group’. A member of a majority community in a State does not fall within the purview of a ‘group’. ‘Hate propaganda’ is an offence against the minority community and not otherwise. Organised and targeted violence, hate propaganda, financial help to such persons who commit an offence, torture or dereliction of duty by public servants are all offences only if committed against a member of the minority community and not otherwise. No member of the majority community can ever be a victim. This draft law thus proceeds on an assumption which re-defines the offences in a highly discriminatory manner. No member of the minority community is to be punished under this Act for having committed the offence against the majority community. It is only a member of the majority community who is prone to commit such offences and therefore the legislative intent of this law is that since only majority community members commit these offences, culpability and punishment should only be confined to them. If implemented in a manner as provided by this Bill, it opens up a huge scope for abuse. It can incentivise members of some communities to commit such offences encouraged by the fact that they would never be charged under the Act. Terrorist groups may no longer indulge in terrorist violence. They will be incentivised to create communal riots due to a statutory assumption that members of a jihadi group will not be punished under this law. The law makes only members of the majority community culpable. Why should the law discriminate on the basis of religion or caste? An offence is an offence irrespective of origin of the offender. Here is a proposed law being legislated in the 21st century where caste and religion of an offender wipe out his culpability.
Who will ensure implementation of this Act?
The Bill provides for a seven-member national authority for communal harmony, justice and reparations. Of these seven members at least four of them, including the Chairman and Vice-Chairman, shall only belong to a ‘group’, that is, the minority community. A similar body is intended to be created in the States. Membership of this body thus shall be on religious and caste grounds. The offenders under this law are only the members of the majority community. The enforcement of the Act will be done by a body where statutorily the members of the majority community will be in a minority. The Governments will have to make available police and other investigative agencies to this authority. This authority shall have the power to conduct investigations and enter buildings, conduct raids and searches to make inquiries into complaints and to initiate steps, record proceedings for prosecution and make its recommendations to the Governments. It shall have powers to deal with the armed forces. It has a power to send advisories to the Union and State Governments. Members of this authority shall be appointed in the case of Union Government by a collegium which shall comprise the Prime Minister, the Home Minister and the Leader of Opposition in the House of People and a leader of each recognised political party. A similar provision is created in relation to the States. Thus, it is the Opposition at the Centre and the States which will have a majority say in the composition of the Authority.
What are the procedures to be followed ?
The procedures to be followed for investigations under this Act are extraordinary. No statement shall be recorded under section 161 of the CrPC. Victim statements shall be only under Section 164, that is, before courts. The Government will have a power to intercept and block messages and telecommunications under this law. Under clause 74 of the Bill if an offence of hate propaganda is alleged against a person, a presumption of guilt shall exist unless the offender proves to the contrary. An allegation thus is equivalent to proof. Public servants under this Bill under clause 67 are liable to be proceeded against without any sanction from the State. The Special Public prosecutor to conduct proceedings under this Act shall not act in aid of truth but ‘in the interest of the victim’. The name and identity of the victim complainant will not be disclosed. Progress of the case will be reported by the police to the victim complainant. The occurrence of organised communal and targeted violence under this Act shall amount to an internal disturbance in a State within the meaning of Article 355 entitling the Union Government to impose President’s rule.

Offences which are defined under the Bill have been deliberately left vague. Communal and targeted violence means violence which destroys the ‘secular fabric of the nation’. There can be legitimate political differences as to what constitutes secularism. The phrase secularism can be construed differently by different persons. Which definition is the judge supposed to follow? Similarly, the creation of a hostile ‘environment’ may leave enough scope for a subjective decision as to what constitutes ‘a hostile environment’.
The inevitable consequences of such a law would be that in the event of any communal trouble the majority community would be assumed to be guilty. There would be a presumption of guilt unless otherwise proved. Only members of the majority community shall be held culpable under this law. Members of the minority community shall never commit an offence of hate propaganda or communal violence. There is a virtual statutory declaration of innocence under this law for them. The statutory authority prescribed at the Central and State level would intrinsically suffer from an institutional bias because of its membership structure based on caste and community.
I have no doubt that once this law is implemented with the intention with which it is being drafted, it will create disharmony in the inter-community relations in India. It is a law fraught with dangerous consequences. It is bound to be misused. Perhaps, that appears to be the real purpose behind its drafting. It will encourage minority communalism. The law defies the basic principles of equality and fairness. Social entrepreneurs in the National Advisory Council can be expected to draft such a dangerous and discriminatory law. One wonders how the political head of that body cleared this draft. When some persons carried on a campaign against POTA — an anti-terrorist law — the members of the UPA argued that even terrorists should be tried under normal laws. A far more draconian law is now being proposed.
The States will be watching hopelessly when the Centre goes ahead with this misadventure. Their power is being usurped. The search for communal harmony is through fairness — not through reverse discrimination.

Hope and Change

GENERALLY hope triggers change and then change brings about hope. Hope for the better today and the best tomorrow. Be it any class of the society – Hope and Change cycle keeps on rotating. Recent results of elections in 5 states prove it. Somewhere the longest rule has been changed; somewhere the old guard is back – both mark change. Issue is what is the hope that people live on? Is it decided by their day-to-day needs or the long term future or any other things matter? Those who are in the field of social sciences and also in politics will vouch that there are no hard and fast rules about what really people look for when they change the current rule – especially in a democracy. Without going into the history of who ruled when Bharat got freedom from the British and then who and then who; let us see the main hope and change cycles that are evident now.
In West Bengal, the Left ruled longer than any other state government. Their promise was welfare of farmers and labourers. Quite a convincing platform for votes in a country like Bharat where poverty rules the roost and these two classes are the most downtrodden. People in Bengal waited long for the promise to get fulfilled. Bharat always gives a long rope. But when the basis of the promise shatters, Bharat overthrows even the mighty. The moment the Left changed their behaviour to farmers, labourers and started pleasing those whom they always despised–industries and foreigners (of course, other than Chinese!), their base shattered and the same time there was this lady–an epitome of simplicity–who came as a saviour of the farmers in Singur. Singur was a trigger and hope was the basis for this change.
In Kerala as well, the Left lost their base and they had to blame ‘communal polarisation’ for their debacle, without realising that they themselves survive on many types of polarisation –haves and haves not; upper class and not–so-upper-class etc. They in Bengal and in Kerala made Muslims so overpowering displacing the rightful Hindus that the same Muslims this time overthrew them! Kerala change does not reflect majority hope; it reflects no optional situation for majority and a strategic victory for Muslims for their long term plan to finally rule Bharat. Those who tie up with Muslim League claiming that Muslim League is not a communal party, must see how recently the party has helped the Popular Front – a parallel Islamic Army in Kerala! This change has a basis of a lost hope of majority and a vicious ambition of Muslims there.
Assam saw many Jehadi attacks and infiltration. There too majority chose the current party only on the hope that the encroachers will be taught a lesson as per the promise by the sitting CM who apparently has kept majority protected despite central pressure on him to appease the infiltrators for votes. But even Assam may soon lose its faith in what they chose unless he strongly handles the strong opposition that has only one agenda – to wipe out majority Hindus in Assam and to wipe out janjatis. Assam has voted for the sitting CM there in the hope that he would uproot Pakistan’s flags from many districts of Assam, get poor janjati people in the mainstream and give employment to the locals rather than appeasing the infiltrators. If he does not live to this hope, then people will hope for the change!
Tamil Nadu has its own set of hope and change. Simple but very emotional people there have been polarised on the basis of castes by many politicians. Some may say that due to corruption, the current government lost. Without going into the details of corruption by each party there, let us believe that there could be just an other dimension to this change – Hope that those who lost earlier have now realised the aspirations of the people and now they would give their best. This hope has no limits. Some may see it as anti-incumbency; some may ask–what really was another option? If corruption could be the base for change then Bharat will not elect most politicians at least for next 20 years!
Some try to paint all these changes as ‘development group’ Vs ‘Vote Bank Group’. It is an open secret that no party or no politician anywhere in the world thinks of anything else other than his/her vote bank. Issue is that when there is a basic drift from the core voter group–for bigger ambitions–then the core voter group goes in for a change and for a new hope! Majority always cherishes the dream of a better today and the best tomorrow. Development is the key to it; but the moment the majority sees that this development is being done at the cost of majority farmers; Hindus and other poor then the same majority uses the only weapon it has in a democracy–Vote. Tamil Nadu saw great state highways, good industrial growth and better crop. But Tamil Nadu also saw a fierce attempt to hurt majority Hindus by breaking Ram Sethu in the name of development; they also saw a family benefiting more than the poor in the villages. Development did not catch votes; change came about. People in Bharat know who truly do total development including that of the majority farmers, labourers, janjati people etc and who ‘fake’ development at the cost of farmers, majority and the likes!
It has become a fashion and a conspiracy these days to polarise the society in 2 groups – Development group and those who suggest that development can be done using alternatives–are termed anti-development! Fancy presentations of sparkling IT parks, malls, roads-destroying fertile land, cow grazing land, ecology-saving natural coasts and ancient monuments of the rich civilisation may sparkle limited people’s eyes for some time; but then the farmers, Hindus and all others with them will vote for change the way they did in Bengal, Tamil Nadu, etc.
It is really the time for all to introspect as to what really was the hope shown to the people and what was given into their hands! People of Bharat also now have to fast think of the real safety and security of their kids, their businesses, their beliefs and of course paramount to all is their nation–Bharat. Small changes make way for big hope; but now there is no time for going so slow giving long ropes to the same people, who time and again failed to deliver, failed to set up clean systems and failed to protect Bharat’s majority. It is time for the perfect Hope and therefore for the big and complete change!

Athirathram” - one of the most ancient and sacred ritual associates with Vedic Dharma

The Panjal Athirathra Yajnam..takes 12 days to complete and is a very complex process involving Rig, Yajur and Sama Veda recitation and procedural details. Though Athirathram had been performed in 1990 and in 2006 as well, the importance of this Athirathram is that it is again being conducted in Panjal after a gap of 35 years. Panjal in Thrissur District in Kerala is considered as Yajna bhumi as it has a history of several Yajnas in the past.

…Panjal Athirathram 2011, should be treated as the Dharma Karyam of the year. In fact, one would have expected Governments of both Kerala and India to show support and make arrangements to ensure success of this project. However, Government of Kerala is going for polls while Government of India is busy supporting other causes. Vedic Rituals like Athirathram evoke immense sense of history among Hindus, the battered ones of this wretched and ungrateful country. As our tradition is slowly eroding in the waves of modernization, events like Athirathram give some hope that future generations may know that ancient Hindus were not barbaric lot as pictured in some History books, but were masters of various sciences.

Temples have been demolished in the Valley on a daily basis. The world could not care less. An American had once told me: ?Why should we care? Indian democracy is led by the majority who are Hindus and you want us to talk about the human rights of the community of rulers??
We do not have much time, in fact about 45 years, as the X-graph of statistical regressions estimated by J.S. Bajaj and colleagues shows. ?X? represents the two trends?Hindu percentage declining and Muslim percentage rising, and intersecting in the year 2061.
We Hindus must understand the true nature of Islam before we can formulate a strategy to defeat those who threaten us.

Thanks to Shri Vedantamji of the VHP, I had visited Thondi and Rasathipuram Municipalities of Ramanathapuram and Vellore districts respectively, and was truly shocked by what I saw. Both these municipalities are in Muslim-majority areas, and the local bodies election had empowered the Muslims with their capture of the municipalities.
The Muslim-ruled municipalities have thereafter converted these areas into mini Dar-ul-Islams, in a Hindustan of 83 per cent Hindus! The minority Hindu areas of the municipality were thus denied civic amenities, funds for schools, garbage clearing etc., and sent notices in Urdu. Hindus were bluntly told convert to Islam if they wanted civic facilities.
I could not believe that in South India this was possible where Hindus are actually above national average at 90 per cent of the population. I know that in Kashmir Valley, Muslims who are in majority have actively or passively connived in driving out half a million Hindus out of their homes and made them refugees in their own country. Temples have been demolished in the Valley on a daily basis. The world could not care less. An American had once told me: ?Why should we care? Such atrocities are happening not only in Kashmir, but in other parts of India as well in pockets wherever Muslims are in majority, e.g., Mau and Meerut. In pocket boroughs of India, thus, Dar-ul-Islam has today returned to India after two centuries. Considering that a demographic re-structuring is slowly but surely taking place, with Hindu majority shrinking everywhere, Dar-ul-Islam in pockets might indeed, like amoeba, proliferate, coalesce, and jell into a frightening national reality?unless we Hindus wake up and take corrective action now, actions for which we shall of course not get a Nobel Peace Prize.
Dar-ul-Islam is a Muslim religious concept of a land where Muslims rule, and the non-believers in Islam are termed as Dhimmis. The term Dhimmi was coined after the Jews were crushed in Medina [Khaybar to be exact], and the defeated Jews accepted that if they did not convert to Islam, then they would accept second-class status politically, culturally, and religiously. This included zero civil rights including the right to modesty of women, and the special tax jaziya.
There is thus no scope for Muslims and non-Muslims uniting as equals in the political, cultural, or social system in a Dar-ul-Islam where Muslims rule. Secular order in India thus is possible only when Muslims are not in power. Thondi, Rasathipuram and other places prove that the Muslim mind suffers from a dangerous duality?of seeking secularism when out of power and imposing a brutal demeaning theocracy for non-Muslims when in power.
It is this duality that patriotic Hindus must re-shape by modern education and other means, as also retain its demographic overwhelming majority in India. The dhimmitude of Jews in Medina and later in Mecca represents the beginning of religious apartheid inherent and basic to Islamic mores, and practised long before what we saw in South Africa on the basis of colour and race, and that which became prevalent during the Islamic imperialist rule in parts of India. Hindus had been dhimmis for six hundred years in those parts of India despite being a bigger majority in the country than even today. Hence, a majority is not enough. Hindus need also a Hindu mindset to be free.
In his presidential address to the Muslim League in Lahore in 1940, Mohammed Ali Jinnah had articulated this concept of apartheid in his own inimitable way:
?To visualise Hindus and Muslims in India uniting to create a common nation is a mythical concept. It is only a fancy dream of some unawakened Hindu leaders?. The truth is that Hindus and Muslims are two different civilisations?. since their thought process grow on different beliefs.?
Large sections of Muslims in India then had rejected Jinnah and his concept of non-compatibility of Muslims with Hindus. But after Independence and Partition, instead of building on this rejection by many Muslims, the Nehru era saw increasing pandering precisely to the religious element that believed in this apartheid. Indira Gandhi vigorously continued this appeasement thereby nurturing the apartheid mentality of Muslim orthodoxy.
But the final undermining of the enlightened Muslim came when the government capitulated in the Shah Bano case. Thousands of Muslims had demonstrated on the streets demanding that the government not bring legislation that would nullify the Supreme Court?s judgment in the Shah Bano case but in vain. Rajiv Gandhi, I learnt later, on counsel from his Italian Catholic family, had surrendered to the hard line clerics who protested that the Supreme Court had no right to interfere and to de facto amend the Shariat, the Islamic law code. These relatives on a directive from the Vatican thought that if secular law would be applied to Muslims, it can be to the Christians too.
This was a nonsense argument of the Muslim clerics, since the Shariat had already been amended, without protest, in the criminal law of India. The Indian Penal Code represents the uniform criminal code that equally applies to all religious communities. I therefore ask the clerics: if a Muslim is caught stealing, can any court in India direct that his hand at the wrist be cut off as the Shariat prescribes? If Muslims can accept a uniform criminal code what is the logic in rejecting the uniform civil code?
In India, Dhimmi status for Hindus during Islamic imperialist rule has had other social implications. Defiant Brahmins and Kshatriyas, who had refused to convert and chose to remain Hindus, were forced to carry night-soil and suffer great indignities for their women folk. Or it meant gross mental torture. Guru Tegh Bahadur, for example, had to see his sons sawed in half, before the pious Guru?s own head was severed and displayed in public.
The debasement of Hindu society then was such that those targeted valiant Brahmins and Kshatriyas, who had refused to convert and thus made to carry night-soil, were disowned by other Hindus and declared to be asprashya or ?untouchable?. The ranks of the Scheduled Caste community, which was not more than 1 per cent of the population before the advent of Islam in India, swelled to 14 per cent by the time Mughal rule collapsed.
Thus, today?s SC community, especially those who are still Hindus, consists mostly of those valiant Brahmins and Kshatriyas who had refused to become Muslims but preferred ostracization and ignominy in order to remain Hindus. Hindu society today should offer koti koti pranams to them for keeping the Bhagwa Dhwaj of Hindu religion flying even at great personal cost and misery.
I have already written enough in these columns about Hindus being under siege from Islamic fanatics and Christian proselytizers. I have suggested that we can lift this siege only if we develop a Hindu mindset, which is a four dimensional concept. But that mind must be informed, and understand why others do what they do to Hindus before we can defeat their nefarious designs. Here I suggest therefore that we Hindus must understand the true nature of Islam before we can formulate a strategy to defeat those who threaten us. In a later column I will write about the true nature of Christianity and how to combat the menace of religious conversions of Hindus.
At this juncture let me add even though I oppose conversion as violence, as Swami Dayanand Sarasvati boldly wrote to the Vatican Pope, nevertheless if an Indian Muslim or Christian changes his religion to Hinduism today, I will not regard it as conversion because it is a return to the Hindu fold of those whose ancestors had been forcibly converted.
Unlike Hinduism, which says not a word against non-believers, in fact says that other religions also lead to God, Islam is harsh on them, and justifies violence against them as sacred. The choice to non-believers in Islam is: convert or accept dhimmitude. Hence, the explanation for Thondi, Rasathipuram, Mau etc., and the duality in ethics practised by Muslims everywhere. A true Muslim is Dr. Jekyll when in minority, and Mr. Hyde when in majority.
So what should we Hindus do? First, recognise that being a pious Hindu is not enough. Hindus must unite and work to install a Hindu-minded government. If 35 per cent of the 83 per cent Hindus unite to vote for a party, absolute majority is attainable. If Hindu Dharma Acharya Sabha, RSS, and VHP decide to mobilise the voter to support a party that espouses an approved Hindu agenda, then the union government is within reach through the ballot box. Second, search for those Muslims who are ready to openly and with pride declare that their ancestors were Hindus. My guess is that about 75 per cent of Muslims will be ready to do so. These are the Muslims who can be co-opted by Hindus to fight Islamic fundamentalism. If we do not do so, then the Muslim clerics will have a free run of their fanaticism.

Third, invest heavily in primary education to make it world class, ban the madrasas for any student below 21 years, and make Sanskrit a compulsory language for all students

LONDON: Indian women were subjected to "virginity tests" in the 1970s before being allowed entry into the United Kingdom, a directive strenuously denied by Prime Minister James Callaghan in 1979 to then Indian prime minister Morarji Desai. These and other details have emerged from declassified British home ministry files.
The tests, to check whether Indian women claiming to be brides or fiances of British subjects were indeed so, took place at the United Kingdom's missions in Delhi and Mumbai. The home ministry papers, according to the Guardian newspaper, reveal that entry clearance officers "sought medical opinion on the marital status of some female applicants".
UK's foreign ministry officials are said to have confided to the Guardian that there were 73 cases in Delhi and nine in Mumbai. The Indian government angrily protested against the "humiliating and obscene" practice. The UK Border Agency, which now deals with immigration issues, stated, "These practices occurred 30 years ago and were clearly wrong."
In the late 1970s, the women were subjected to intimate examinations by immigration officers, as the records put it, to "check their marital status". The British government assumed that a bride or a fiance in India would be a virgin; if it transpired an applicant was not a virgin, immigration could be refused.
Virginity tests were banned in February 1979 after reports that a 35-year-old Indian teacher was put through the rigours by a male doctor at Heathrow. The idea was to determine that she was a genuine wife-to-be who had not borne children and a virgin.
"This practice was appalling and degrading," said Indian origin British MP Keith Vaz. Lawyer Sarosh Zaiwalla said, "The British government owes an apology to the Indian community.'
Reacting to the report, the UK's home office initially denied any internal examination. However, the woman told the Guardian that she signed a consent form for vaginal gynaecological examination because she feared she would otherwise be sent back to India. She asked to be seen by a lady doctor, but was refused.
The now-released home office files record that after the incident became public, the woman was offered 500 pounds to ensure she didn't sue the UK government. The payment was "in recognition of the distress she was caused", but she also had to agree "not to initiate any proceedings against the home office".
According to the Guardian, the home office at the time stressed the money was not a compensation, which would have implied immigration officials had acted improperly. Then home minister Merlyn Rees expressed his "deep regret", but did not extend an official apology.
The Joint Council for the Welfare of Immigrants here had demanded an apology. Its spokesperson said, "Whilst in 2011 we may no longer be virginity testing South Asian brides, the sad reality is that many migrant women continue to be denied equal treatment."

Adopting a politically impartial stance, this book, the product of an intensive multi-year research project, uncovers the invisible networks behind this Hinduphobia, narrates the Indian Diaspora's challenges to such scholarship, and documents how those who dared to speak up have been branded as “dangerous”. The book hopes to provoke serious debate. For example:

The kuji may have arrived in Japan via Buddhism,[99] where it flourished within Shugendō.[100] Here too, each word in the kuji was associated with Buddhist deities, animals from Taoist mythology, and later, Shinto kami.[101] The mudrā, a series of hand symbols representing different Buddhas, was applied to the kuji by Buddhists, possibly through the esoteric Mikkyō teachings.[102] The yamabushi ascetics of Shugendō adopted this practice, using the hand gestures in spiritual, healing, and exorcism rituals.[103] Later, the use of kuji passed onto certain bujutsu (martial arts) and ninjutsu schools, where it was said to have many purposes.[104] The application of kuji to produce a desired effect was called "cutting" (kiri) the kuji. Intended effects range from physical and mental concentration, to more incredible claims about rendering an opponent immobile, or even the casting of magical spells.[105] These legends were captured in popular culture, which interpreted the kuji-kiri as a precursor to magical acts.

OBL never said a word about jihad in Kashmir till 2005 whn he was guest of ISI - fantastic post in BR
OBL was never an enemy of India, except in the broadest ideological sense. Just because he became the poster-boy of "dangerous Islamism" for the west, we do ourselves a disservice by adopting that image wholesale and applying it to an Indian context where it is not at all relevant.
Indeed, I believe the presence of OBL in our subcontinental neighbourhood was in fact a net gain for India. Let me explain why.
1) In the early 1990s, the US was full of hyperpower hubris. They had just won the cold war and destroyed the USSR, and Pakistan (via its support for the Afghan war) was appreciated as a key player in that campaign.
These times were the apex of influence for the Brzezinski/Scowcroft school of American foreign policy in the State Department, and Milt Bearden/Michael Scheuer were the victorious lions of the CIA. Many political figures of future importance, such as Madeline Allbright (and Robin Raphel further down the ranks) were rising stars under the tutelage of these worthies.
These people could do or say no wrong, as far as the US establishment was concerned. And what they were saying was that Pakistan must be THE primary US proxy in fashioning the new world order in South/Central Asia.
2) I know it is an assiduously created myth by the US media that Afghanistan and Pakistan were "ignored" after the Soviet withdrawal from Afghanistan. Nothing could be further from the truth.
A deliberate power vacuum was engineered in Afghanistan following the Soviet withdrawal, one that only Pakistan was capable of filling via its proxies. Washington, at that time, favoured the creation of an Af-Pak under Islamabad's TSPA/ISI rule. It fit in with Washington's game plan perfectly.
3) The game plan was ultimately, to create an Af-Pak dagger aimed at Western China and the former Soviet states of Central Asia. A dagger that could potentially play the same role against China as it had against the Soviets when needed...even as China was engaged economically by the US. Additionally, such an Af-Pak power under Islamabad could stabilize the Eastern flank of West Asia, threaten a recalcitrant Iran, and give the US "pro-Islamic" credibility with the Arab street.
Essentially the very "Great Game" ideas behind the creation of Pakistan in 1947, were seen to be "borne out" by the eventual usefulness of Pakistan in defeating the Soviet Union. Extending those same ideas, Pakistan (with Afghanistan as its vassal/strategic depth) was now going to be the launch-pad for expanding Western influence into the Asian heartland and containing America's potential competitors in that theatre.
This whole aspect of US foreign policy in the early 1990s was played out much more quietly than the rebuilding of former Soviet satellites in Europe, and the eastward expansion of NATO. Much more money (and publicity) were allocated to Marshall plans for Poland, Hungary and the Czech Republic. The creation of the AfPak dagger was a relatively modestly funded effort with a much lower profile. This is not surprising; one of the attractions of Pakistan to the US has always been its willingness to sell itself cheaply.
4) For this US proxy Af-Pak to enjoy unchallenged dominance in Central Asia, serving as an uniterrupted conduit for US forces in the Persian Gulf and Arabian Sea into the Asian heartland... it was vital that this Af-Pak should include all of J&K as well.
Hence, in the early 1990s, a multi-pronged assault was launched with the backing of Washington, to enable Pakistan to separate J&K from India. The assault had a military component, masterminded by Mirza Aslam Beg and Hamid Gul, in which Afghan war veterans and CIA expertise were used by the ISI to launch a "war of a thousand cuts" against India. It also had a political component, as evidenced by the redoubled efforts (via Robin Raphel) to build the Hurriyat Conference as a "democratic" platform for secession.
5) India at that time was seen to be a helpless state, from Washington's point of view. It was a former Soviet ally and not deserving of trust or sympathy. The strong leadership of IG was a thing of the past. India had slipped into a state of post-dynastic political turmoil following the VP Singh ascension of 1989... this was projected by Washington to mean political instability and lacklustre economic performance for the rest of the decade. To top it all off, in 1991 India had to go to the IMF with hat in hand.
Thus pressure was put on India from every direction to part with Kashmir. Our pleas to declare Pakistan a terrorist-sponsoring state were soundly ignored. We were lectured as never before on Kashmiri "human rights". When the ISI committed terrorist atrocities, such as the Mumbai '93 blasts, US investigators dutifully "misplaced" the evidence of Pakistan ORF ammunition given to them for examination. IMF strings were pulled taut whenever India made any move to assert or consolidate its regional position.
Had it not been for PVNR, our greatest Prime Minister to date, at the helm in those dire years... the plan to separate Kashmir might even have succeeded.
6) In support of the fiction that "Af-Pak was ignored after the Soviet withdrawal/ Pakistan felt betrayed by the US".... the laughable Pressler Amendment (which prohibited US arms sales to Pakistan on account of its nuclear weapons program) is often cited.
In truth, the Pressler Amendment was completely spurious as a non-proliferation tool. Pakistan already had nuclear weapons by 1990, tested and produced by China... and the US knew it. Given nuclear weapons and a large, well-organized offensive machine for subconventional warfare... jihadi veterans of the Afghan war and growing cadres of local Tanzeems... the Pakistanis could very well wage terrorist jihad in Kashmir without fear of conventional retaliation from India. The US knew this as well as TSPA/ISI did... hence, it did not matter at all if TSPA/ISI were denied conventional armaments and F-16s under the Pressler Amendment. In fact, such things could be held up as carrots by Washington to further guarantee TSPA/ISI's future cooperation in the great game.
In the 1990s, from Washington's point of view, it was more than enough to let Pakistan have control of Afghanistan and conduct nuclear blackmail against India. TSPA/ISI's economic strength did not suffer as a result of the sanctions... they had income from the Photochor nuclear proliferation industry via BCCI, and income from heroin sales via the Afghan poppy fields they controlled. They would do Washington's bidding, well-financed as they were through all these unorthodox mechanisms to which Washington turned a willing blind eye.
Thus the myth of the "Pressler Amendment" being a symbol of Washington's "negligence", "neglect" or even "neutral even-handedness" is nothing but a hoax.
Eventually, Washington was betting that India would tire of the sustained nuclear blackmail/terrorism from Pakistan and buckle under political pressure from the western world, giving up Kashmir. Then India could be turned into a docile, decapitated cash cow while martial Pakistan, imperial overlord of Af-Pak-Kashmir, could become the West's frontline soldiers for the dominance of Central Asia.
Managing China, Iran and resurgent Russia, rather than containing India, was the thrust of the 1990s Great Game. India, it seemed, would be a pushover.
7) The early and mid 1990s were truly dark days for India, as many of us remember. J&K was overrun by thousands of foreign mercenaries of the ISI, trained in Afghan camps under the tutelage of Hekmatyar and others. Pandits were ethnically cleansed from the valley by the lakhs. Dost Gul occupied the Hazratbal shrine and IA could not get him out. Harkat-ul-Ansar with its British-Paki cadres (including Omar Shaikh) were trying to "internationalize" Kashmir by kidnapping and murdering Western tourists. Meanwhile LeT and other groups were recruiting Punjabis to wage jihad in J&K, and also building bridges with the Islamist underworld of Dawood Ibrahim to terrorize the rest of India. Month to month, it seemed that we would inevitably lose Kashmir to an irrepressible wave of jihad.
At that time, we were growing our economy bit by tiny bit. We were still fighting the Khalistani separatists in Punjab, also supported by Pakistan and tacitly by the West. Northeastern insurgencies also received a tremendous boost in this decade.
As the decade wore on, China's tremendous economic rise caused it to gain political influence in Washington with the Hamiltonians. The Clinton-Wilsonians (Albright/Brzezinski) jumped on the Hamiltonian bandwagon, and it seemed as if the US was prepared to accept China's nominal overlordship of the Asian continent, to Pakistan's benefit and at India's expense. Washington even suggested that China could be an "honest broker" in mediating between India and Pakistan on Kashmir!
It was only through the greatest and most steadfast heroism that we stood firm through these times. This was the WORST of jihad we faced in Kashmir.
And Osama Bin Laden/ "Al Qaida" had NOTHING WHATEVER to do with it.
8 ) All the above is background.
Now we come to the story of OBL in the Indian subcontinent.
It begins in 1988 when OBL split from the Maktab-el-Khidamat, the organization that was originally formed under ISI/CIA aegis to funnel funds, weapons and materiel to the Afghan jihad. The rest of the OBL story can be seen as an effort by the TSPA/ISI to woo OBL back into their sphere of influence... with US support until 9/11, and for their own purposes after 9/11.
But in 1988, he split from the Maktab, because he saw the US and the West (including Israel) as a greater enemy of Islam than any power that the Maktab was focusing on. That was the birth of OBL's very own Pan-Islamic agenda.
OBL's mission was intensified in 1991, with the stationing of US troops in Saudi Arabia after Desert Storm (whose successful completion also contributed to Washington's hyperpower hubris.)
The stationing of US troops in the Holy Land of Islam, galvanized Bin Laden to declare Jihad against the West.
9) Bin Laden's chief targets were always the USA, the wider West, and Israel.
His base of operations was initially KSA, from where he was banished to Sudan in 1992. His chosen theatre was East Africa and the Arabian peninsula at this stage. However, he was already beginning to set his sights on the American homeland, as evidenced by the 1993 WTC bombing in which his associates like El-Sayyid Nosair and Ali Mohammed played crucial roles.
Around 1993-94, the charismatic Sheikh caught the attention of many Islamist opportunists from all over WANA, including splinter groups of the Egyptian Muslim Brotherhood who had been lying in wait for just such an opportunity. Fighting against Western-proxy dictators in their home countries, people like Ayman Al-Zawahiri could hope for neither political success nor personal glory... but under the banner of a pan-Islamist international Jihad against the greatest of Satans, all that might change!
Thus, the nucleus of Al-Qaeda was engendered.
10) It is important to note that at this stage, OBL never said a word about jihad in Kashmir.
In fact, I don't recall him mentioning Kashmir at all until about 2005. By that time he was a "guest" of ISI and the Hizbul Mujahedin, probably at Abbottabad. So, he was probably just relieving his polite obligations to his hosts by including Kashmir in his speeches.
There is a good reason why OBL... concentrating on Israel, the West and US-proxy-KSA...could not care less about Kashmir.
It goes back to the Arab Ghazi psyche.
To people like OBL, disputes like Kashmir are beneath contempt for an organization of Al-Qaeda's scope and ambition. They are squabbles between lesser beings, not worthy of his time or effort.
OBL (and most Arabs) do not see the Pakistanis as birathers. In fact, they see the Pakistan-India conflict as something not very serious; it is a case of upstart recently-converted SDREs fighting against kaffir, but highly Dhimmified and harmless SDREs. If a serious conflict erupts, Pakistan (as Muslims) must be supported; however, it is better to maintain a distance from both Pakistan and India in general. Both have their uses... Pakis as servile mercenaries and dalals for China; Indians as cheap, docile and sometimes skilled labour. The idea that India constitutes a "threat to Islam" would have made an Arab Ghazi like Bin Laden laugh... Kashmir or no Kashmir.
11) 1996 is a pivotal year in our narrative.
The Taliban consolidates TSPA/ISI's grip on its Af-Pak empire... with the full blessings of Washington.
India is in dire straits. After PVNR, her governments are falling within months. Economic reforms are progressing erratically. Kashmir jihad is at its height... and now, with Taliban in Afghanistan, it seems that Pakistan will have even more capacity to leverage its strategic depth and intensify that jihad even further.
At this fatal moment, the Taliban invite OBL (whom Sudan is trying to expel) to come to Afghanistan.
12) The Taliban's invitation of OBL to the Indian subcontinent is secretly welcomed by many... including Riyadh, Washington and Islamabad.
The US and Pakistan would very much like to see OBL turn his assets and energies towards the ongoing Af-Pak jihad against India. Saudi Arabia would be very happy with this as well.
If OBL and Al-Qaeda throw their weight behind the Kashmir jihad, they will be diverted from targets that actually matter to Washington... the US, Western countries, Saudi Arabia and Israel.
The TSPA/ISI are happy too... they think that the addition of OBL's Pan-Islamist banner, plus the vast West Asian funding networks of Al-Qaeda to the Kashmir jihad, will give them the ability to push India over the edge. They assure Washington that, with Taliban cooperation, they can keep OBL diverted away from Western interests and towards India.
13) This beautiful plan fails to take into account the tenacity, single-mindedness and commitment of OBL to his grand vision... pan Islamic jihad against the West. As stated before, he doesn't give a cr@p about Kashmir. It is beneath him and his army to get involved in such a lowly scrap. He is after the US, and Israel!
14) What slowly unfolds now, is the eventual demise of Pakistan's best-laid plans for Jihad in Kashmir.
For a while, ISI's "war of a thousand cuts" continues in force. The nuclear tests of 1998 firmly establish Pakistan's capacity for nuclear blackmail against India. In Kargil, Musharraf uses jihadis trained by Afghan war cadre in Taliban-controlled Afghanistan, as the thin edge of TSPA/NLI wedge to occupy Indian land. In December 1999, Punjabi Deobandi terrorists use the sanctuary of Taliban-controlled Kandahar to hijack IC814 and demand the release of Maulana Masood Azhar, a development that leads to the creation of Jaish-e-Mohammed.
Everything seems to be going well for Pakistan. But meanwhile, OBL isn't involving himself in J&K (other than a few massacres of rebellious Shias in the Northern Areas at ISI's request.)
On the contrary, OBL is using Taliban/ISI sanctuary to mount attacks on US interests in East Africa and the Arabian peninsula... Embassies, Khobar Towers, USS Cole.
And finally, on Sept 11 2001, he masterminds the attack on Washington DC and New York City that makes him a household name.
15) The rest is recent history which we know very well.
The Americans launch Operation Enduring Freedom, ousting the Taliban from power in Afghanistan, and replacing them with Karzai.
The TSPA/ISI chooses to GUBO to the Americans. Their betrayal of the Taliban and Al-Qaeda has lasting consequences. One by one, the Deobandi groups nurtured by the ISI go over to OBL's side. Wahhabandism becomes a sociopolitical force unto itself, and eventually the TTP is born.
This is exactly the opposite effect of what the Pakistanis had hoped to achieve by inviting OBL to Afghanistan. They had hoped that they could influence OBL to turn his attention away from the West and KSA, and towards India in J&K.
Instead, OBL has turned Pakistan's own proxies (created to wage jihad in J&K) against the US... and against Pakistan itself!
In effect, forces that were committed to the J&K jihad are now more committed to fighting the Americans in Afghanistan!
Besides this, the generous sources of funding which OBL used to bring into Afghanistan (and of which, some must have been siphoned off by ISI to use against India) quickly dry up under American pressure against the financial conduits. So even that fringe benefit of OBL's presence, quickly disappears for the ISI.
Net gain for India, any way you look at it, compared to the 1990s.
16) 2002 is another pivotal year.
OBL escapes from Tora Bora and into Pakistan proper. From here on he is shielded from the Americans by the ISI in a cat-and-mouse game lasting a decade. The ISI still hopes to use him as a figurehead of jihad in J&K... and if all else fails, sell him out as the ultimate bargaining chip to the Americans.
Meanwhile, the NDA government in India launches Operation Parakram in response to the Parliament Attack. The buildup of Indian troops along the IB alarms the Americans, who do not want their sizeable commitment of forces in Af-Pak to become embroiled in an Indo-Pak war zone.
Washington now starts to lean on Islamabad to rein back terrorism against India. Notably, terrorism against India in J&K goes into a steady decline from 2002 onwards... showing that J&K jihad was completely, entirely in the hands of ISI, and had nothing to do with OBL/Al-Qaeda.
17) From 2005 onwards, the character of the Afghan conflict changes. The ISI begins to use specific proxies among the Taliban to do its bidding in Afghanistan... including the Haqqanis, Hafiz Gul Bahadar, Maulvi Nazir, Hekmatyar etc.
Meanwhile the TTP (joined increasingly by Punjabi tanzeems following the Lal Masjid episode) intensifies its attacks on the TSPA/ISI. In following years, Swat is overrun, GHQ is attacked. The war overflows the FATA and NWFP into the heartland of Pakistan.
From 2005, ISI terrorism picks up again in India, not so much in J&K but elsewhere. LeT is used to build cadres of local terror cells owing allegiance to SIMI and the so-called "Indian Mujahedin." There is no evidence that any of this is related to Al-Qaeda, TTP or the Wahhabandi tanzeems.
OBL may have provided his blessings to these efforts as a gesture of gratitude to his Pakistani hosts... but he did not have either the assets, experience or reach within India to do anything of practical use. The LeT and ISI have far more assets in India than "Al Qaeda" ever did. So why would they need him as a "guiding light" or anything else?
In 2008, the ISI and LeT launch 26/11 against Mumbai in a desperate attempt to force military action by India, hoping that the various tanzeems fighting in Pakistan will unify under TSPA as a result. It doesn't happen.
18) The Obama administration, from 2008 onwards, takes an increasingly hard line towards Pakistan. Drone attacks are stepped up, and focus increasingly on Waziristan, where those factions of Taliban loyal to the ISI are based. TSPA defiantly refuses to engage in any military action in Waziristan.
Meanwhile it is the sunset of OBL's career. He is now ensconsed in an ISI/Hizbul Mujahedin safehouse far from the Afghan border, and close to the J&K border. Finally, he starts to mention J&K in his speeches. But this is no more than chai-biskoot.
It is unfounded to imagine that OBL played any significant role in J&K jihad, alongside the TSPA/ISI who betrayed him by GUBO-ing to the Americans. Why would he, when wars far more important to him were going on in Afghanistan, in Iraq, in Yemen? Why would he, when J&K had never been a matter of consequence to him in the first place?
19) Some have suggested that, near the time of his capture, OBL was a virtual hostage of the ISI in their Abbotabad safe-house. However, it's important to note that... while ISI had him by the balls, he also had them by the balls. It's not as if they could force him to take any greater role in J&K than he wanted, or force him to become involved to any greater extent than lip-service for politeness' sake.
What could the ISI do to him... hand him over to the Americans? In doing so, they would lose their primary trump card, their greatest bargaining chip of all. They would also earn the instant wrath of all the jihadi tanzeems that still remained loyal to TSPA, and possibly of allied Taliban factions in Waziristan as well (the formerly ISI-allied Maulvi Nazir in South Waziristan has already declared Jihad against Islamabad following the Americans' raid on Abbotabad!)
By 2011 the TSPA/ISI had been forced into a corner. 89% of drone attacks by the US in 2010 had been against ISI-proxy Taliban factions in N. Waziristan. Meanwhile TTP in Orakzai, Malakand and Bajaur had begun to hit back in force against the TSPA, including raids in Dir and Swat. The Raymond Davis episode, among other things, had forced US-Pakistan relations to the point of nearly public hostility.
The TSPA/ISI knew they could not keep up the show of defiance for very much longer. By summer the IMF had to approve critical loans that Pakistan needed to survive. If the only way out of this was to play the trump card... to sacrifice Osama Bin Laden, who was never any use to them against India anyway... so be it.
19) This brings us to the final chapter concluded last weekend: the American raid on the Abbotabad HM Safehouse where OBL was hiding.
The event is shrouded in mystery.
Could the US have conducted the raid without any knowledge of the TSPA/ISI top-brass? Unlikely.
However awesome the stealth helicopters, the NAVY seals, the high-tech jamming gear etc... there were just too many things that could have gone wrong with a purely unilateral operation, for Washington to risk it. From JSOC choppers getting shot down, to a fire-fight in urban Pakistan including civilian collateral damage, to the mistaken launch of a Pakistani nuke against India. Just too many unpredictable outcomes to consider, if the US had actually "gone it alone."
BUT BUT BUT... if Pakistan AGREED to let the US snatch OBL, why did they not bargain for a more H&D-saving facade? Why did they not insist that OBL be "found in the border regions of Afghanistan" rather than the very embarrassing location of Abbotabad? Why did they not angle for more recognition of their cooperative role so that they could get generous baksheesh in reward from the US Congress? Why did they submit to a raid that makes them look so very bad, in terms of H&D, and in terms of casting suspicion on their role in harbouring OBL all these years? Why did they let SEALS cart away incriminating evidence from the location instead of delivering Bin Laden to the Americans on their own terms?
There is only one possible answer: the Pakis may have agreed to let the US snatch OBL on such humiliating terms because... the only alternative available to the Pakis was WORSE. Unkil has something so damaging to the Pakis, that he was able to threaten them with it, and dictate the terms of how the OBL raid was going to go... or else.
What is that "WORSE" thing? I don't know.
I have a suspicion that it might revolve around two trials currently taking place in the US, though. The trial of Tawwahur Hussein Rana in Chicago; and the trial in NY where the families of American 26/11 victims are suing the Pakistan Army and ISI. Things which could have come out in those trials and become public information, may have been even more damaging to Pakistan than the mere fact of OBL hiding in Abbotabad all these years.
20) For India... for the last 20 years, we have faced jihad alone. We will face it alone for the next 20.
USA/Al-Qaeda squabbles don't matter to us; USA-Pakistan lovefest doesn't matter to us; Pakistan-China double teaming doesn't matter to us.
We have survived the connivance of all these parties under much worse circumstances, when we were much weaker. With the wisdom of our ancestors, the courage of our people, and the virtuous sword arm of Dharma on our side we shall continue to survive it until we prevail. Jai Hind!
